Man Awarded Over 1m euros In Car Crash Settlement

A 22-year-old man from who lost the use of his right leg following a road traffic accident has received just over €1m in a High Court settlement.

Brendan Hayes, from Limerick, Ireland, suffered significant injuries to his lower and upper body after the car in which he was a passenger in struck a wall and caught fire in an accident near Limerick on September 9, 2004.

Due to his injuries, Mr Hayes had to have his right leg, from below the knee, amputated and has had to use a prosthetic leg ever since.

Mr Hayes took action against the driver of the car Sam Houlihan and the insurance company Quinn Direct .

It was alleged Mr Houlihan was negligent and in breach of his duty of care to Mr Hayes due to the nature of his driving at the time of the crash.

The court previously heard Mr Houlihan accepted liability for some, but not all, of the injuries sustained by Mr Hayes.

The two parties reached an agreement on the third day of the hearing, with counsel for Mr Houlihan announcing the family was consenting to a €1.05m settlement which would go towards Mr Hayes' future care.

Mr Hayes continues to suffer pain in his knee and lack of strength in his right hand grip, and has been unable to work in the five years since the car accident .

The court was also told that the house Mr Hayes was currently living in was "totally and wholly inadequate" for his needs.

Mr Justice Michael Hanna said he had "no hesitation" approving the settlement as it was clear Mr Hayes had endured a difficult and stressful time.
